1. Acceptance
By accessing and using the website esaab.cl ("the Site") you accept these terms in their entirety. If you do not agree, please do not continue using the Site.
2. Description of the service
The Site is an institutional online presence of the ESAAB platform, operated by Zettavision SpA. It includes:
- Information about the product and value proposition
- Contact form
- Public documentation (when available)
The Site is NOT the ESAAB SaaS platform. Access to the operational clinical supply platform is governed by a separate commercial contract between Zettavision SpA and the contracting organization.
3. Intellectual property
All Site content (text, graphics, code, logo, diagrams) is owned by Zettavision SpA or used under license. Reproduction, distribution, or modification without written authorization is prohibited.
4. Acceptable use
You agree to:
- Not attempt to access non-public parts of the Site.
- Not perform automated scraping without written authorization.
- Not send spam, malware, or illegal content through the contact form.
- Not use reverse-engineering techniques on the Site's code.
5. Limitation of liability
The Site is provided "as is". Zettavision SpA does not warrant:
- Uninterrupted availability (we are subject to maintenance and cloud infrastructure failures).
- That marketing information is free of typographical errors or minor outdatedness.
- That the contact form delivers 100% of messages (depends on email providers).
To the maximum extent permitted by Chilean law, Zettavision SpA shall not be liable for indirect damages, loss of profits, or incidental damages arising from the use of the Site.
This limitation does NOT apply to:
- The ESAAB SaaS platform when operating under commercial contract (liability governed by said contract).
- Damages that Chilean law does not allow to be limited contractually.
6. Privacy
Personal data processing is governed by our Privacy Policy.
7. Changes
These terms may be updated. The last update date appears at the top of the document. Continued use of the Site after a modification constitutes acceptance of the new terms.
8. Jurisdiction and governing law
These terms are governed by the laws of the Republic of Chile. Any controversy shall be resolved before the ordinary courts of Santiago, Chile.
